401(k) Plans and Retirement Planning in Hong Kong: Key Distinctions

A 401(k) is a U.S. employer-sponsored retirement plan. It is not Hong Kong’s statutory retirement scheme, and living or working in Hong Kong does not by itself make an individual eligible to participate. For a Hong Kong hire, employers should assess local retirement obligations separately from any existing U.S. plan.

401(k) and MPF serve different legal purposes

Participation in a 401(k) depends on the sponsoring employer’s plan and applicable U.S. rules. Hong Kong’s Mandatory Provident Fund (MPF) system covers eligible employees and self-employed persons aged 18 to 64, subject to statutory exemptions. Employers should check coverage for the individual rather than assume that nationality or an overseas retirement account settles the position.

A 401(k) does not automatically replace MPF obligations. Some people entering Hong Kong for employment may qualify for an MPF exemption, including certain members of an overseas retirement scheme. The statutory conditions must be checked and the exemption basis documented.

Tax treatment must be assessed by jurisdiction

Traditional pre-tax 401(k) contributions and investment earnings may receive U.S. federal tax deferral. Roth contributions receive different treatment. These rules do not establish the Hong Kong salaries-tax treatment of contributions or withdrawals. Cross-border taxation depends on the individual’s circumstances and requires advice from an appropriately qualified adviser.

What employers should confirm before onboarding

  • Whether the employee is covered by MPF or qualifies for an exemption.
  • Which entity is the legal employer and who handles enrolment, contributions and payroll records.
  • Whether any existing overseas plan permits continued participation after the employment or location changes.
  • Which benefits are statutory obligations and which are additional contractual benefits.

NNRoad’s service scope

NNRoad supports applicable MPF administration within an agreed Hong Kong EOR or payroll engagement. The written proposal specifies the responsibilities for enrolment coordination, contribution processing and records. MPF administrative support should not be described as a U.S. 401(k) investment service.

For employment support, see our Hong Kong EOR service. Questions about a U.S. retirement account should be directed to the plan administrator and, where needed, an appropriately qualified tax or financial adviser.
