Choosing an EOR Company in Brazil: 10 Checks Before You Sign

Insights · By Chen ChunJie · Updated 24 October 2026

The best employer of record in Brazil is the one that can show you, before you sign, who employs your hire, how the arrangement is structured under Brazilian law, what the full cost is, and how payroll, benefits and terminations are handled. These ten checks help you compare providers on facts rather than claims.

Last reviewed in October 2026 against the CLT, Law 6,019/1974, Constitutional Amendment 141/2026 and official eSocial, INSS and FGTS sources. General information, not legal or tax advice.

Checklist of ten checks to make before choosing an employer of record in Brazil

The 10 checks

1. Who employs the person in Brazil?

Ask which Brazilian entity signs the CLT contract and registers the employee on eSocial, and how long it has employed people in Brazil.

2. How is the service structured under Law 6,019?

A provider should explain how it directs its employees, how the scope of work is defined, and how approvals work between you and the employee.

3. Is the collective agreement checked before the offer?

Salary floors, benefits and the annual adjustment date come from the CCT for the role and city. A quote without this check is incomplete.

4. Does the quote show every cost?

Look for INSS, RAT, third-party contributions, FGTS, 13th salary and vacation accruals, benefits, the service fee, the deposit and how exchange rates are applied.

5. What is the payroll calendar?

Ask for cut-off, invoice and pay dates in writing, so salaries are always paid by the 5th working day.

6. How are terminations handled?

The provider should review notice, job-protection rules and the FGTS penalty before any conversation with the employee, and pay the settlement within 10 days.

7. Who supports the employee, and in what language?

Employees need answers in Portuguese on payslips, leave and benefits; you need a single contact in your language.

8. How is data protected?

Ask how employee data is processed under the LGPD and, where relevant, the GDPR.

9. What happens when the law changes?

The move to a 40-hour week (Constitutional Amendment 141/2026) is a good test: ask how the provider will update contracts, schedules and payroll.

10. Can you leave or transfer employees easily?

Check notice terms, deposit refunds and how employees move to your own company when you incorporate.

Red flags

  • A single “all-in” price with no breakdown of charges and accruals
  • Advice to engage a full-time, directed worker as a PJ contractor
  • No answer on which entity employs the person
  • Salaries promised in US dollars
  • No written payroll calendar

Questions about choosing a Brazil EOR

There is no single best provider for every company. Compare providers on who employs in Brazil, how the service is structured, cost transparency, payroll reliability and support. The ten checks above cover these points.

Shortlist two or three providers, send each the same role, city and salary, and compare the written proposals line by line.

Look for experience with technical roles: intellectual-property clauses, remote-work terms and equipment policies. See hire engineers in Brazil.
